This is the story of how I was detained by the Department of Homeland Security after returning to the U.S. by air on April 2, 2013. I was returning from a family visit to my brother in Ecuador. When the customs agent asked me the usual questions: "Where did you go," "How long were you there," I said I wanted to remain silent.
I had tried not answering questions on two previous occasions, without serious ill effect, both times at SFO in San Francisco. The first time, the border agent put a red mark on my customs declaration and sent me through without further questions. The customs agent gave me a hard time, trying to ask me questions for about 40 minutes in the public examination area, threatening me with detention and a bag search. I just clammed up and he let me go. The second time was even easier: I got the same red mark and no more questions from the border agent, and that was it. Not even pulled aside for a secondary inspection, I just walked on out.
Times are approximate. I didn't have a watch, and in detention I didn't want to risk reading the time on my phone. Inside the cell it's very hard to estimate time.

Plane arrives in Miami. There is a long walk to passport control, something like ten minutes. I have all my baggage, only hand baggage. Get called to the ESCOBAR's desk, smile.
"Where you coming from?"
"I wish to remain silent."
"You wish to remain silent?"
"That's right."
"What, you have a bad trip?"
...
ESCOBAR calls over FRANK IBRAHIM.
"How you doing?"
"I wish to remain silent."
Some other question.
...
They both look at the screen. Indistinct conversation. Something about "when you scan the passport, that automatically validates ... what you gotta do in this case is ... sometimes there'll be a Russian or something passport with the number ... it's a different country, just a mismatch ..."
IBRAHIM: "You got a driver's license or some other ID?" I give him my driver's license. "See, he's a U.S. citizen, from California. You originally from California? No, Colorado. He doesn't have to answer any questions, he's got every right. It just means more work for him and more work for us. I'm satisfied he is who he says he is. But when you don't answer questions, that gives me a bad feeling. You carrying anything you're not supposed to?"
"No, of course not."
"You gonna answer questions?"
...
"Okay, go stand over there."
I stand with another woman with a stroller who is also being taken to secondary. After a couple of minutes we go to the right, then turn left, then go through a door into the waiting room. "Have a seat. It might be a while."
The waiting room has a bunch of the typical airport conjoined benches. A TV in the corner playing ESPN. There are eight numbered cubicle-like desks, some with an agent behind them. People are called to a desk or to the back hallways intermittently. After a while I count 47 people including me, maybe about three-fourths of the seats filled, but that's only in the part of the room I can see. There's another room with a TV that has more desks and chairs. I'm in the waiting room for a long time.
Other people are coming in, some in groups, each being told to take a seat. There are signs on the walls saying no phones, no photos. The agents enforce these signs not thus:
"Talking on phones is not allowed here."but thus:
"Hey! See the sign?"Some who come in later than me are called back earlier. A group of British people come in and complain to one another about the lousy American welcome they're receiving.
A family comes in, a father, mother, young daughter, and baby in a stroller. The mother apparently lacks a passport or something. She is called back and starts to gather her family to go with her. No—just you, and she goes back alone.
While sitting there I realize that I still have two apples from Ecuador in my backpack, that I meant to eat in the plane. I realize I will have to admit the mistake when they search my bags. I'm mad at myself because it's best to have your customs ducks in a row when you try a protest like this. It turns out not to matter, because the waiting period is so long, at least 90 minutes, that I end up eating the two apples before my name is called.
There's a white-haired agent tromping around being chummy with the others. I later learn this is DURAN. He's acting jocular and saying things like "You gotta keep track of that shit" to the other agents, right in front of the detainees. I feel he should be wearing a baseball cap backwards or something.
I lose hope for making my connection. ESPN is talking about a Rutgers basketball coach throwing balls at his players. Eventually AEDO calls me back.
A long room with rolling chairs and three monitors in the back. Two of the monitors are showing the Windows "Press CTRL-ALT-DELETE to log in." We sit down. AEDO asks me where I'm coming from.
"I refuse to answer any questions because I don't think I should have to answer questions to get back into my country."
"Yeah, so where you come from?"
...
AEDO walks into the hall where I hear him talking to someone. He paraphrases what I just said and laughs. I get moved into the adjacent room, a dark room with agents, probably dark because the windows may be two-way mirrors looking into detention cells. ROMERO enters. Romero says that he's the boss around here. ROMERO says that I don't have to answer questions, but that they can detain me until they are satisfied I'm not a danger to the country. He says it's for safety. He asks if I agree.
"I understand your motives." I restate that I'm not answering any questions.
"All right." A couple of guys take me out to the hall. One says, "I think you're making your life more difficult than it needs to be but I guess that's your choice." Talking audibly about me: "They do this kind of thing at highway checkpoints too, refuse to answer all questions. He doesn't know it's customs and border patrol, two different things." Into a small square room with benches. Ask me to put my bags down. Hands against the wall, spread 'em. ARENAS pats me down. There's a cigarette on the ground, they ask if it's mine. Search my bags in front of me. Take my wallet and give me back the cash. Make me take out my shoelaces, search my shoes, and give me my shoes back. They take me out into the hall again and to a storage room where they tell me to put my bags.
They lead me, shoes flip-flopping, to the forensics room which is connected to the waiting room by an open doorway. Here I am supposed to have my fingerprints taken. There are about five agents in there, all meathead types. I can read a monitor with ALEXEY's information on it. ALEXEY is there waiting to have his prints taken. He speaks with a Russian accent. He has short gray hair in a military style. He wears a black T-shirt with an American flag, a M-16, and the words "I kill jihadists for beer money" on the back. He speculates that the shirt may be the cause of his detention.
"This my second time to the states. I want to make vacation in Miami because it's beautiful and low cost."
"Lemme see your shirt," says an agent.
"I was in Chechen army, we fought jihadists."
"How long ago you get out of the army?"
"One and half years."
"Maybe my shirt is cause of the problem."
"Don't worry man, you cool. We like you. We agree with you."
They ask ALEXEY to step outside, clapping him on the shoulder and saying "Thank you for your service." DIAZ takes up the jihadist thread and starts complaining about muslims. "Fucking ragheads. You know the thing though, we're the ones who gave them the weapons to fight the Russians with." Another agent: "It's all politics man, it don't matter who's in charge." All seem generally in approval of killing jihadists, or at least no one speaks to the contrary. With ALEXEY out of the room they start talking about him.
"We should just call him Borat. Isn't that what he said, he's from Kazakhstan?"
"You know he got sued for making that movie? Kazakhstan sued him for like 20 mil. But the movie made 40 mil."
They finally call me up to get my fingerprints. The agent taking my fingerprints tries to make conversation about my Art After Dark shirt.
"After Dark? What is that, trance or something?"
I smile and say, "I'm not answering questions, man."
Right thumb, right index, right middle, right ring, right little, left thumb, left index, left middle, left ring, left little, right thumb flat, right four fingers slap, left four fingers slap, left thumb.
Back to the dark office where ROMERO previously talked to me. DIAZ from the forensics room is there to question me too.
"Where do you come from?"
"I'm not answering questions because I don't think I should have to answer questions."
"You mean like pleading the fifth? I'm not putting you under arrest. I'm not your local cop arresting you. Now where you come from? And you do have to answer that."
"You wanna put that in writing?"
"Your ignorance of the law is... is not... doesn't excuse you. This is a border seach and the fourth amendment doesn't apply. And that is in writing."
I stare out the window into the waiting room.
"All right, you wanna play this? Fuck this."
He angrily gets up and leads me, shoes still flip-flopping, to the detention cell.

Detention cell. Bright white with smudges on the walls and scuffs on the floor. Metal benches along the walls, shabby air mattresses on the floor. There is a two-way mirror with blinds behind. To the left of the mirror is a door labeled "toilet." I sit motionless at the *. Someone comes in and offers to let me answer questions so I can go. I again refuse. The agent locks the door with a key that is attached to an 18-inch long piece of metal.
There are a lot of noises when you're sitting still. You can hear a lot of what's happening in the hall when people are near the door. I hear in the ceiling above a kind of clanking and something that sounds like a roller bag rolling. I wonder if the people above know there's a prison complex underneath them. I hear the secret Zelda sound play a couple of times, probably some agent's ringtone.
The key clanks noisily and the door opens. Another prisoner gets dropped in the room. He looks like a young guy. Also no shoelaces. After the door closes he rushes to it and taps on the glass. The guard returns and the prisoner asks for his pillow. He gets the pillow and goes to his bench and lays down. The other guy doesn't try to talk to me.
I try to keep still as long as possible. I play "Bad Romance" and "Losing My Religion" in my head. I focus on a triangle of specks on the floor. I wonder if I can sit still for an hour, but it is hard to estimate time. Eventually they come and take away the other guy.
Once a guy opens the door and asks if I want any food. I say not now.
My legs get tired and I begin sitting cross-legged on the bench. The key clanks again in the lock. It is DURAN and two other agents.
DURAN: "My guys have informed me that you're refusing to answer questions. I'm the boss here. You've reached the top. Isn't that right guys, I'm the chief around here?"
The other two guys kind of nod.
"This can be real easy or real hard. You can be out of here in five minutes, or it might be five days, or five hours. How this is going to work is in six hours we're going to open the door and give you some Dinty Moore stew and see if you feel like talking. After another six hours we're going to open the door and give you some Dinty Moore stew, and maybe some Spam. If you still won't cooperate, then things are going to escalate, up to and including sending you to Jackson Memorial to get some X-rays. Now are you interested in talking?"
I pause a second before answering. "Respectfully, I'd rather not talk to you in particular. I saw your conduct in the waiting room and I found it unprofessional." The subordinates hear what I say. I think DURAN is a bit flustered.
"Am I being unprofessional now?"
I have to admit there's nothing unprofessional about him now.
"Now why do you think you don't have to answer any questions?"
"I haven't done anything wrong, and I hate being treated like a criminal when I haven't done anything wrong. I'm not smuggling anything."
"You think you're being treated like a criminal?"
He may be able to withstand the irony in his question but I cannot. I let crack a smile, and lift my arms to indicate the prison cell I am sitting in. "Well, yes."
"You feel like a criminal being put in detention?"
"Yes."
"You feel like a criminal having your shoelaces taken away?"
"Yes."
"You understand all these things are for your safety? We can't let you have shoelaces trying to do things you shouldn't be doing. My guys offered you food, right?"
"Yes."
"That's true."
"My guys didn't handcuff you, did they?"
"No."
"And that's because so far you've been cooperative." He leaves somehow after I don't answer any more questions.
The other prisoner gets put back in the room. He gets some food, which he seems to have been anticipating. It looks like a big clear plastic bag with Doritos, maybe some tuna, and also a dish of water. I don't get a good look because I am staying in character sitting on the bench. Later the guy gets taken out again.
I start to wish they wouldn't open the door so often. I had been mentally geared to sit for six hours. It's taking me out of the zone. I start to fear when they will come back in and ask me more tricky questions and I wish they would stay away.
DURAN comes to the door again. He explains that someone is going to take me to get my stuff so it can be with me. This sounds good because I've been nervous having my computer out of my control. They instruct me to get up. I start to walk out the door and DURAN says "Stop right there." I wait at the open doorway.
"You a smoker, Mr. Pfeiffer? No? Then why do you have a cigarette lighter in your baggage?"
I am dumbfounded. I wonder if they would try planting evidence on me. "I can't think of why there would be one, unless someone put it there."
"This isn't your property?" He walks up with an evidence bag containing what looks like a belt and a cell phone charger. It's not mine.
"No, it's not mine." What a dipshit. He yells at one of his guys, asking who the bag belongs to.
They walk me to the storage room where my two bags are. I explain that those are my only bags and that I didn't have any checked baggage. Oh. They hadn't realized that. They were going to take me to get my checked baggage so it could also be put in the storage room. Well then. They put me back in the detention cell.
I sit some more. I wonder how long I can go without eating. I wonder how long before I start to feel sleepy and whether I should try to sleep on the floor or on one of the mattresses. I wonder when the next shift change will be, when I can maybe get someone else who won't be so concerned about saving face and will let me go. I think about Henry David Thoreau and Steve McQueen. I try to figure how long I've been locked up. I figure it's been at least an hour, maybe two. DURAN comes in and I wait at the doorway while he walks away. At this point I could swear I heard him joke "Just kill him" to another agent. He summons me to another room. MARIA OTERO is sitting on the edge of the table.
DURAN: "Now this is my boss. Now you're really moving up the chain."
OTERO reaches out her hand. I decide whether to shake it and she says "No handshake?" and I shake it simultaneously. She says they know I'm a U.S. citizen and I need to answer the questions. He're I'm made up to answer their questions and I try to get some things straight.
"My understanding was that it's not required to answer questions at passport control."
"Border agents have the authority to question you and you have to answer the questions, even if you're an American citizen. You have to do it, I have to do it, even the President has to do it." I keep myself from rolling my eyes at this last remark.
"What kind of questions can they ask?"
"Where you're coming from, how long you were gone, whether you're single, things like that."
"What is the purpose of these questions?"
"To find out where you've been and see whether you consitute a threat."
OTERO continues. "I'm going to leave and come back in 15 minutes to give you some time to think. If don't want to talk after that, then we have to call my boss, make marks on your file, and you don't need that. You're young, you travel a lot, you don't need that." I reflect later that kindly as she was, she was essentially threatening me with extrajudicial punishment if I didn't do what she said. "I'll be back in 15 minutes."
I don't need 15 minutes. "I'll answer questions but I'd like to report some possible misconduct among your staff." DURAN notices this remark; I guess he thinks it's about him. OTERO replies,
"All right. We'll have an officer ask you questions and then we'll have the others leave the room and you can tell me your complains, and I promise to act on them. Do you want me to leave while they ask you questions?" I say she can stay.
There's a wait while they look for someone to ask me questions. They are looking for AEDO because he's my primary officer or something, but can't find him. They bring in another random guy, who asks the usual questions in about 10 seconds: "Where you come from, how long you there, what was the purpose of your visit?" They ask me to get up and leave, but then there is an argument outside. Apparently AEDO has showed up and wants to ask more questions. They sit me back down.
AEDO has a stack of papers. They look like Internet printouts about me. I see my FOSDEM portrait on one of them. The FOSDEM printout looked like it was this page: https://archive.fosdem.org/2010/schedule/speakers/david%2Bfifield.html which was linked from the image suggestions on a Google search of my name.
AEDO asks me what is this "GNB or something?" that I give money to. I guess that he means GNU and I explain. He asks about my previous trips to Japan, New Zealand, and South Africa. He also asked me about some "eye retina scanner" that I work on and I have no idea what he is talking about. "Called Nmap?" I say, "No, that has nothing to do with biological eyes. That's the software I work on. It's a network security scanner for security audits." He asks me about Sustainable Roots. He claims to have heard about it when I answer, but I suppose he had just Googled it before. I think he had my brother's name written on the sheet and at least one other name.
AEDO leaves and OTERO remains to take my complain. She takes notes of what I say. I tell her about DIAZ and the "fucking raghead" remarks. She asks for direct quotations and names. DIAZ's is the only name I can remember, but I give the general tenor of the forensics room. I tell about the Borat remarks. She asks if there are witnesses and I tell her that ALEXEY is the only possible one. She says they will check to see if he is still in custody. That's all I have to say. She says she will give me her email address before I leave and asks that I send her a full statement with everything I can remember. She asks about my connecting flights and says she will check into getting me on the next flight to my destination. She promises to take action on my report. I never ended up with her email address, but I decided I'm not sending mail to DHS agents from my personal email address anyway.
They take me back out into the hall to collect my stuff. It looks like it has been unpacked and repacked once again. I check for the important things and start relacing my shoes. AEDO is sitting there watching me.
"What finally got you to talk, if you don't mind me asking?"
"Actually I do mind." I finish putting my shoes back on.
"Where's Menlo Park, anyway? Near San Francisco?"
"Yeah, pretty close." I am pretty fucking done answering this guy's questions at this point.
AEDO takes me back out to the waiting room. I was ready to walk out the door but I realize I'm still actually a prisoner, though the chairs are more comfortable here. I ask a man what time it is and he says 8:20. I sit in here for about another hour. Finally DURAN calls me back again to the dark office.
"There's an officer here who's going to take you down. You're done here but you still have some customs inspection to do." He informs me that there are no more flights today; I say I can take care of finding a hotel to fly tomorrow. On the way out I see that the woman with the stroller from earlier is still there, in one of the rooms talking to an agent as I pass. The guy (I forget his name) takes me out, around, down an escalator, and in through the out door to the X-ray customs station. On the way he tries to talk to me.
"I kind of walked in on the middle of this. I hear you weren't answering questions?"
I can't tell if his concern is genuine or feigned. "I didn't know what I had to answer and what I didn't."
At the X-ray station he does a thorough search of my bags again. "I know they checked your stuff upstairs, but I gotta check again."
"You do what you gotta do."
He pulls everything out, checks all the pockets, send the empty backpack through the X-ray. They're waiting on something and he talks to CRAWFORD, just barely audible. "I don't know, something must have triggered." I guess they were expecting to find something. "It must have been something."
They ask me the same kinds of questions as before and I answer them. The guy says to me, "I didn't realize you were up there for so long. I though you just landed, but it's been since like 2:00?" It's past 9:00 now.
"Yeah, quite a while. They don't let you go until they're satisfied, and it took them a while to get satisfied."
"They way they were talking about you, made you sound like some kind of monster. But what I'm seeing here is a totally different person."
"Well, different people have different points of view."
"Yeah, but you're cooperating with everything, I don't get it."
He asks me to empty my pockets and takes my wallet. He goes through my cards, which irks me because it seems like exactly the sort of thing customs officials should not do, and there is no way to fight it. He sees my student ID.
"Stanford, huh?"
"Yeah, I just finished a master's degree."
"What in?"
Even though it kind of feels like a casual conversation, I know that he's looking for inconsistencies in what I say. "Computer science."
"Ha ha, that's more than I know." You're damn straight about that.
He takes my cards away to do some checks or something. CRAWFORD makes conversation while the other is away, checking something on the phone. "When the officer is asking you questions, it may feel like they're being antagonistic, but it's not about that. I have to do the same things as you when I travel. I look at it this way: I just want to get from point A to point B in the most efficient way possible."
Something in me is screaming, "At whatever cost to your rights?" but I don't speak it. Instead I ask the question,
"Suppose they ask you, 'So who'd you vote for?'"
"Well, that's not really a pertinent question, so what I'd do is ask to see a supervisor. Where you're coming from, how long you were gone, those are relevant. Who'd you vote for, whether you have a dog, not relevant. Whether your parents are still living, not so relevant." I can tell he is not sure about that last one. "So what I recommend is when they ask something you don't want to answer, is you ask for a supervisor and say that you don't think the question is pertinent. Just a little friendly advice."
Okay, guy. Try asking to see a supervisor when you're being questioned at passport control and see where that gets you.
The other guy comes back and give me my wallet and passport back. He seems surprised that it is over, like he missed doing something, like he expected to find something.
"I guess that's it."
"Out this way?" I ask. He nods. I walk around the corner, over the rubber pad, and out through the opened doors into the sweet sweet air of freedom.
CBP Googles your name while you sit in detention. The timestamps in these logs are mountain time, which is two hours behind Miami time. The first hits at 16:30 correspond to 18:30 in Miami, which is probably while I was still in the detention cell. The next at 17:40 are 19:40, which is right around the time I was being taken to the meeting with OTERO. Maybe they couldn't find AEDO because he was still doing web searches.
Cool that Google gets a list of people detained by DHS.
